The Architect / Engineer is creative by nature but avoid risk in every sense of the word. In the event innovations can improve the performance of design, they can take action towards improving the profession and their practice while providing a better quality of project/product.
Presented by an experienced Design and Construction Lawyer and a multi-patent holding Architect / Engineer, the session will discuss the Architect as an Innovator and managing the risks associated with new creative ideas in design. The Architect / Engineer is in the best position to allow for innovations (creative ideas) of design in their work and encourage the consultants the same. But protection of risks should be allocated to the beneficiary of the risks (the Owner). We will look at the Architect / Engineer as the risk taker and the risk allocator and discuss how each are addressed and what is the proper protocol and protection.
Learning Objectives:
- Learn where and when to take and allocate risk in an innovative/creative design and offer proper protection of ideas.
- Discover how to inspire consultants to be creative and take on new ideas for the benefit of a project.
- Inspire their clients to allow for creative new ideas of building performance to the benefit of the project.
- Distribute the risks between the project parties and still allow for creativity among all involved.
- Techniques and contract specifications to protect the project risks under certain circumstances.

Designing both commercial and residential projects, working as architect, construction supervisor and consultant for numerous individual and corporate clients. The last 19 years he has specialized in sustainable, high efficiency commercial/residential building practices. Designing net-zero and off-grid structures has required innovative design practice. Working with local and national contractors to develop the next level of construction equipment and methods. As a Faculty Associate with the University of North Texas, William is dedicated to educating city officials and the general public in the benefits of sustainable, energy efficient, design and construction. A knowledgeable speaker on unique designs, he has given educational talks throughout Texas and Mexico.

An active instructor, Mitchell has been a speaker at AIA National Conventions, the Texas Society of Architects state conventions, the Dallas & Fort Worth AIA chapters, the Texas Society of Professional Engineers, and is an ongoing guest lecturer for the Department of Civil Engineering at the University of Texas at Arlington. He received the AIA Professional Affiliate of the Year Award (2012) and the Consultant Award (2019) from the Dallas AIA chapter. His opinions have been published in the AIA publication, Columns, the Dallas Business Journal, Texas Bar Journal, and the Texas Lawyer. He serves on the advisory board for the Dallas AIA publication, Columns. Mitchell is an Ironman Triathlon finisher, a two-time finisher of the Portland Marathon, a finisher of the Dallas White Rock and San Antonio Marathons, and holds several awards for running races in Texas and Oregon, where he attended law school. He lives in Southlake, Texas, where he is a volunteer coach for youth sports and swims with the North Texas Nadadores Masters.
